I had never heard if they had ever paid. The place was ran like the federal government, were operating in the red when they left the ACC.

I think it was deducted from future revenues they were due so they didn't write a check at the time.

which they kept at the time of settlement. This had nothing to do with GOR though. It was prior to that. GOR is the problem $ , not the exit fee.

This is not really relevant to FSU/Clemson. If there truly are grounds to void the ACC/ESPN contract (FSU seems to be confident that there is) there is no way the GOR is enforceable and the ACC exit fee will be negotiated WAY down as they could claim the ACC failed to manage the league competently.

Pretty simple argument: the ACC has so mismanaged the league that they had the first undefeated P5 conference champion left out of the 4 team playoff. Not only is there immediate financial damage to FSU by not getting the payout this year but they have permanently damaged the FSU brand in the future, making them a laughingstock and setting precedent for treating ACC teams as less than.

It’s an argument I made here before that is a part of the suit. ESPN has operated in bad faith. It was always a conflict of interest for them to be the primary stake holder in two competing leagues. It’s why most sports are governed under anti-trust exemptions. They’ve clearly acted in favor of the SEC despite having fiduciary duty to the ACC. The ACC, at the conference governance level, has acted in bad faith towards member institutions by conferring with ESPN and other partners and agreeing to unfavorable terms. They Raycom deal as a perfect example of conflict of interest and bad faith.

How did ESPN determine the CFP participants? Fill me in here. What I saw was at least 5 former ACC coaches and players on the CFP committee.

and playoffs themselves. they were openly lobbying to have fsu left out..in fact they were saying it while rational people were saying there is no way they get left out. ( they got left out) would be interesting to see the fsu lawyers move to have communications between he playoff committee and what not

Agreed. The broadcasters on-air during events were advocating. Even if ESPN wants to argue that color commentators are “editorial” virtually every member of every broadcast team was advocating this position. Any of those people who have ever been referred to as journalists by ESPN would be falling outside the bounds of their profession. These lines are blurred in sports because the pro-leagues operate under anti-trust exemption and can do whatever they want. NCAA/ACC/SEC and ESPN’s interactions with them do not have such exemptions and I have little doubt that ESPN runs afoul of anti-trust regulation in their dealing with college football. Remember that the NCAA negotiated all tv rights for college sports until that was broken up under anti-trust regulations.

of the ACC when the exit fee was established, so it was reduced. But they probably paid significant lawyer fees in addition to their reduced exit fee. Kinda like when UNCheat paid lawyers a lot and took years to get out of probation.
