should be immune to fromrosecution for any criminal activity while in office, citing that it will cause a "vicious cycle of prosecutions" of former presidents.
Then there is just basic logic, that would suggest giving blanket immunity to a sitting president would incentivize criminal activity because they are immune from prosecution.
His logic makes about as much sense as, "We should not charge any people with crimes, because somebody might be trying to get even with them". This shows a complete lack of faith in, as well as cynicism toward our justice system in which he holds one of the highest seats.
How is this one of our brightest legal minds?

Do politicians do shady ### #### to get things done? Yes. It *should* be in the best interest of the country, but I realize it's not always that way.
Has every President done something illegal when dealing with other countries to get something done? I'd bet on it. So if the standard changes, we'll start dragging everyone through the mud.
Dems impeach Trump. Repubs try to impeach Biden. It's childish games at the highest levels.

I think the important part is if the President does something as part of their official duties as President. Maybe that gets some kind of immunity. Things the President does outside of that even while in office should not protected.

So, Biden can commit war crimes, order the National Guard to fire on protesters, then rape a female staffer, and all of it would go unpunished under Alito's logic because, and get this, criminal prosecution could be seen as revenge.

Agree…but many senators abdicated their responsibility in this particular case, likely for fear of retribution. If they had acted/voted in good faith then this would have all been behind us three years ago.

Putin, Kin Jong, Sadam when he was in power, etc.. operate with immunity from criminal prosecution, and they most certainly abuse this unchecked power.. absolute Power Corrupts and this flies in the face of everything our founders fought for when they freed us from a Monarchy that did not hold the crown accountable for it attrocities.
This should be a no-brainer, Presidents are not ordained, they are public servants elected by the people and should be held to the same criminal standards as the people, or we might as well just hang it up now.

I mostly agree with that. I wouldn't agree with the 'same' criminal standards as the people, because the President can and should have certain powers that everyday citizens do not have. But yeah, if the argument is blanket immunity, then definitely not.

Is that what she said…or was she just dodging an obvious gotcha question from Sen Blackburn?
I don’t even recall having an opinion on KBJ…but if I did, it was probably that she was smarter and more qualified than Thomas or Alito…and I would still stand behind that.

In the context of a confirmation hearing, where a politician is going to try and back you into a corner and put you on record, why give them the satisfaction?

My prediction is that it will be 9-0 that there is not unfettered immunity.
The controlling part of the opinion will be 6-3 or 7-2 against the former president. Alito/Thomas dissenting and maybe joined by Gorsuch/Kavanaugh but I doubt it. Roberts and Coney Barrett will join the liberal ladies to end the Orange One's quest for unlimited power.

I think maybe people are being overly optimistic on this.
This Court is bent. Watching their prior behavior I find it hard to believe they'll do anything but run interference for him without quite going all the way to giving him immunity. IMHO they'll absolutely find a way to delay the trial until after the election.
