Judge issues temporary restraining order on transfer waivers

From the report:
College athletes who were waiting for an NCAA transfer waiver are now eligible to play, a federal judge ruled Wednesday in a court case brought by seven state attorneys general including North Carolina's Josh Stein.
Judge John P. Bailey issued a temporary restraining order in State of Ohio v. National College Athletic Association. The case, which alleges that the NCAA's rules on multi-time transfers violates U.S. antitrust law, was filed last week in the Northern District of West Virginia.
Bailey ruled that the NCAA cannot for 14 days enforce its transfer eligibility rule that requires players to sit out for a year and the NCAA cannot punish players that play (or schools that allow them to) while the temporary restraining order is in effect even if the case is eventually decided for the NCAA.
The judge said the next hearing on a preliminary injunction is Dec. 27.

Players deciding on what rules to be enforced through the courts, that should be the last straw that factors into colleges completely shutting down sports in their universities, and colleges getting back to what it was first meant to do, and that's to educate every student to the best of their ability without any student being referred to as a student athlete. Then let's see how all these players plan on making it in a simi pro league where they will be paid much less than they are able to deal for now, and sports after HS will be done with unless they were good enough to play simi pro sports....

There’s too much money on the table for that. The end result would be millions lost by colleges and a minor league being started like Don Yee tried to do several years ago.

May be off shore Swiss account. The Swiss government is known for making it easy for the wealthy and powerful to hide their money.
Honestly nothing surprises me anymore.

If this holds up as an antitrust issue, this may open the door for State AG's such as in SC and Fl to sue the NCAA on antitrust issues regarding the GOR which binds schools to a conference due to a ridiculous financial penalty based on a faulty contract with ESPN.
If I was Clemson and FSU, I would have the state AG's looking into this.

somewhat unrelated... I recall a few years ago in MLB during a double header, a team traded a player after 1st game to the opposing team between games. Dude undressed left locker room and went to his new team, got dressed and played against his former team about an hour later. I think this is where we are headed.

I wondered about this but if the GOR is found to be unenforceable wouldn’t that mean all contracts are the same? It could mean the end of contracts for everything. Faulty as it may be, all the conference members signed the GOR and even it were called an anti-trust violation (which, in my opinion, it is because of the ESPN involvement) the courts probably won’t touch it because of the ramifications.

I'm no Perry Mason or even Matlock but I see the only way out of this is the Power 5's agreeing that anyone can transfer only once. You can move on to the G5 and others but if you want to play in the Power 5 you'll have to stick it out. I suspect the NIL backers will eventually put riders on their agreements or have them backloaded like Shohei Ohtani's deal.
