CONFERENCE has ever been sued by one of its members for what the FSU suit alleges. It is a landmark law suit and will have far reaching implications for all college athletic conferences. If it proceeds through the court system, it may end up in the Supreme Court.
I don't think the college conferences will want to risk having a court formalize what FSU IS ASKING FOR. Thus, I see the other conferences putting pressure on the ACC to settle this out of court and let those schools in the ACC who want to leave, do so at a reduced buyout fee. If it means the ACC is dead
as a conference, it is better to sacrifice that conference over the SEC AND BIG. FSU has a landing spot in the SEC. BET ON IT. Probably Clemson as well. No way the SEC wants the BIG getting a foothold in the South with recruiting.

This lawsuit will end soon with a settlement for FSU and other teams who want to leave and have a landing spot.
The ACC cannot afford the scrutiny of its poor management practices and policies. FSU would never have filed this lawsuit not knowing in advance how it is going to end for them.

I hope so but I don’t see this at all. This is a simple contract dispute and FSU doesn’t have a leg to stand on. They signed the contract and it is what it is.

I don’t think anyone can be sure of what the lawsuit will do to the league. This will not be an easy fix! Like many lawsuits—- the one with the best lawyers, win. It’s really going to be interesting to follow this to a conclusive decision.
It likely will take a longtime to come to a decision. Contracts are usually very binding so I’m sure FSU thinks they have a way out.

Think you might have part of it correct except it won't be the conference, it'll be the networks.

B1G wants ND and I think they'll eventually have to cave if the acc goes under. Why, because ND would have a very hard time scheduled anyone... the big12 might give them a deal like we did but I doubt it.

I tend to agree, but any settlement that the ACC agrees to is going to have to be harsh enough to discourage other schools to do it.

No one has ever accused Phillips of being forward looking, but his intractableness on this issue seems destructive.

Contracts that become disadvantageous for one party are enforced all the time, and should be. But at some tipping point, when a contract no longer represents reality, and one party sees it as an existential threat, they'll launch the nuclear option. If the advantaged party doesn't recognize what the new situation is and negotiate a new deal, they deserve what they get.

Rather than recognizing this and brokering a dissolution that gives something to everybody, Phillips is now representing the Wakes against the people paying the bills. He seems blind to where that will lead.

One of FSU's arguments is that the ACC is not operating in good faith. His offer to the three new schools was not about the good of the conference, but to prevent what almost happened over the summer, the 8th team joining the willingness to vote to dissolve. The three new schools was about self preservation, not what is good for all the schools. It is an interesting argument. Enough to win? We'll see.

I agree with you that this might be about applying enough pressure on Phillips to operate in reality rather than la la land. But if not, I respect FSU for going all in. This could get good.

I think Clemson is with FSU, though more sanguine about it all. I do wonder why that is. If FSU had something going with this, Clemson joining them would add weight to the arguments. There is a lot happening behind the scenes we don't know about.

Clemson is playing this exactly right. Let FSU be perceived as the troublemaker and Clemson can ride the coattails of the fallout. FSU is going to be in a precarious position as none of these conferences are desperate for new members. Why take them on with a reputation like they’ve developed? Clemson, on the other hand, seems to be silently waiting in the wings to reap any probable benefits.
