Will Title IX impact the NIL?

It has everything else. Let's face it, we have one of the premier female athletes in America in Cagle. Does she have any shot at NIL money?
It's clearly dominating football right now, and will impact men's basketball to a lesser extent, as those are the two money programs. Does the all encompassing philosophy of equity raise it's head in the courts?

I do think Cagle can get some deals now, if she hasn’t already. But there’s no way it would come anywhere near what a big time football player can get.

Title IX will impact this. And we know at most schools big money boosters aren't likely to give equally to women's sports. Not high profile enough. But what it could do is dry up some of the money going to football

than anybody when NIL first rolled out - I think there are a few others in a similar boat.
Since it's not the school paying, Title IX wouldn't come into play regardless.

What was the reaction? The top WNBA players make a little north of $220K per year. Lebron's base salary is 41 million per year. Others make slightly more. What landmark decision has changed any of this? Seems to be supply and demand.

very "progressive," as are many if not most students. A PC attitude is prevalent. Look at the messaging of pro sports leagues right now.
It could be the free market dominates, but it will be with a loud voice screaming for equity regarding dollars. Universities are pretty quick to cave to that

The reason it happened is she already had millions of followers from posting revealing pics of herself on the beach.
I don’t know if anything would be done to stop that sort of thing. But it’s probably not going down a very good path, and I wonder if it would be addressed at some point.

if the money was collected and then distributed equally to all of the student athletes.
Doesn't seem very American, but it would make the eminent, unpleasant, greed of the sport go away.

The top football players will definitely make more but as the dust settles I could see the average female basketball/softball/volleyball athlete making more than the average male in that sport.
Women buy more goods off social media than males. A female influencer advertising products on Instagram / FB can make a career off of it. A lady athlete with savvy social media skills could promote fitness & beauty products could rake it in.

My take is it will be another unholy matrimony between market forces and political correctness.
Cagle is a star, and is arguably the best athlete at Clemson, but unless she picks up a Campbell’s Soup or Wheaties type sponsor (which makes a lot of sense), I suspect her best sponsors will be more local.
Klubnick and Cagle could shoot some wholesome commercials together in a year or so. But of course, market forces will prevail.

Lawmakers can regulate schools but can’t or won’t interfere with the free market with NIL anymore than they would mandate that WNBA players must get the same kind of endorsement deals that NBA players get.
With some exceptions the highest paid college female athletes will be the most attractive athletes at the high profile programs. Some brands will intentionally signal how progressive they are by paying athletes who have “non traditional” beauty. But most of the money will flow to the athletes with super model looks. The market doesn’t care about being progressive unless consumers care about it. Most consumers don’t.

Title IX is a federal law universities must abide by.
NIL is between athletes and private businesses.
There is no overlap. The disparity in NIL agreements between male and female athletes will be enormous. Title IX does not address that.

This argument only works until plaintiffs can show that the university is assisting male athletes in acquiring NIL sponsorships. It won't be hard to prove.

NIL falls outside the scope of Title IX unless the organization that is paying for the NIL deal is educational and accepts federal funding, which almost certainly won’t ever be the case.

Who have started to advertise stuff on social media which I am sure they are getting money from. Ones with significant social media followings. I think a lot of them will be fine.
The athletes who will be left behind will likely be male athletes of the less popular sports

As much as I do not agree with all the NIL money, Title XI has no say over it. Title XI deals with universities and colleges. NIL is outside their coverage. People with money will spend their money the way they want to spread it around. They will just tell Title XI people to stick it where the sun does not shine.

I don’t see how. Title IX only applies to public/government money. NIL cash comes from private parties.
